1. SCOPE

These General Terms and Conditions of Sale set out the terms and conditions that apply to all use of the Website and to sales between SPRING COURT and persons who make purchases via the Website (hereinafter "Customer" or "You").

Use of the Website and sales of products are thus subject to your acceptance of and compliance with these General Terms and Conditions of Sale. Users and Customers who do not accept them must not use this Website.

Customers and users who wish to consult previous versions of our General Terms and Conditions of Sale may do so by emailing their request to contact@springcourt.com, specifying the date of the General Terms and Conditions of Sale they wish to consult.

You represent that You are acting as a consumer, for non-commercial purposes, and that You are of legal age and have full legal capacity, or, as the case may be, that You have obtained the permission of your legal representative or legal guardian.

SPRING COURT reserves the right to reject any clearly disproportionate order for quantities that appear abnormal for a consumer and could be considered professional supply sourcing for commercial purposes.

2. WEBSITE ACCESS AND USE

The Website can be accessed free of charge by any user with access to the Internet. Users are responsible for their own computer equipment and Internet access. Any costs associated with access to the Website will be borne by the user/Customer.

To access their account, users must sign in using their usernames and passwords. Users must keep their usernames and passwords secret and must not disclose them to anyone else.

SPRING COURT will make every effort to ensure that the Website is accessible at all times, but it cannot be held liable for any problem with or malfunction of the Website that prevents access to the Website and/or the different services offered by SPRING COURT. SPRING COURT will do its utmost to resolve any problem as quickly as possible.

3. ACCOUNT CREATION

Users/Customers can create an account on the website to access and take advantage of the services/offering proposed on www.springcourt.com.

In creating an account, users/Customers accept these General Terms and Conditions of Sale and SPRING COURT's data protection policy.

To create an account on the Website, users/Customers must be natural persons aged 18 or over. The account creation form contains mandatory and optional fields. The account will not be created unless all mandatory fields are completed.

All information provided by users/Customers must be accurate. Users/Customers agree to provide only information that is complete, accurate, and current. They also agree to modify, via their accounts, any information that subsequently becomes outdated or incorrect.

Accounts, passwords, and any other information that grants access to the account are strictly confidential information that must not be used by or disclosed to third parties.

Users/Customers are responsible for any use of their accounts by third parties, including any carelessness or negligence on their part.

Confirmation of account creation will be emailed to the email address associated with the account. Only one account per person is allowed.

SPRING COURT reserves the right to delete any account that fails to comply with these contractual terms and conditions.

Information provided to SPRING COURT at the time of account creation will be used only in strict compliance with the provisions of these General Terms and Conditions of Use and our privacy policy, which can accessed here.

4. PRICES

All prices are shown in euros and are inclusive of all taxes, but exclude shipping costs. Shipping costs are specified when orders are placed, and vary according to the delivery option selected, quantities ordered, and the total order amount (see "Shipping and Delivery"). Items will be charged at the prices in effect at the time You proceed to the Website's checkout.

For all deliveries outside the European Union, the client may remain responsible for all customs duties and local taxes.

5. ORDERS

You can place orders on the Website at any time by following the process below :
1- Choose items and add them to your cart. (You can access your cart at any time via the "Cart" tab on each page of the Website to change item quantities or remove items from the cart).
2- Proceed to checkout.
3- Sign in to the Website if you haven't already done so (if You don't already have an account You will be able to create one at this stage of the order process).
4- Choose a delivery option.
5- Accept the General Terms and Conditions of Sale.
6- Choose a payment method and pay via a secured site.
7- You can view the details and total price of your order and correct any errors before confirming your order, which is considered acceptance thereof. 
8- Payment is validated.
9- You will receive an email confirmation of your order.

SPRING COURT will retain title to the items until the order is paid in full, i.e. until it collects the amount of the order.

SPRING COURT reserves the right to cancel or refuse Customer orders for legitimate reasons within the meaning of Article L122-1 of the French Consumer Code.

In placing an order, You are deemed to accept the prices and descriptions of the items available for sale. The photographs accompanying the products on our website are provided for illustrative purposes, and only the descriptions of the products are binding.

SPRING COURT agrees to fulfill orders received via the Website, subject to availability. Products that are unavailable will be indicated as such on the Website.

In any event, if one or more ordered items are not available, SPRING COURT agrees to notify You as soon as possible and, as the case may be, refund You within 30 days after payment is received. Your order will then be canceled automatically.

You can track your order via the "Your Account" section of the Website. You have the right to access your orders for up to 10 years for orders exceeding €120. To do so, You must send your request to SPRING COURT's customer service department: Service Client Spring Court, 5 passage Piver, 75011 Paris, France.

6. SHIPPING AND DELIVERY

SPRING COURT agrees to deliver products ordered as soon as possible and no later than thirty (30) days after the order date.

Delivery times depend on the country and the method of delivery. Please, note that:

  • some countries cannot be delivered. In this case, You will be informed when You will choose a delivery address during your order. 
  • orders placed before 2 PM are shipped the same day, excluding week-ends and holidays. After 2 PM, orders are shipped the next working day.
  • a customs control can be carried out depending on the country of delivery. In this case, Spring Court could not be responsible for longer delivery times.

Orders are shipped by:

  • Colissimo Expert - signature required for deliveries in Metropolitan France
  • DHL Express for deliveries to other countries.

You are responsible for checking the condition of delivered items.
Any problems with the items (damaged goods, items missing from the order, damaged or opened packaging, broken or defective items, etc.) must be reported within three days of delivery.

7. PAYMENT

You may pay for orders using the following payment methods:

  • Bank cards issued in France: Visa, MasterCard, and Carte Bleue
  • PayPal

Once payment has been approved, the delivery (address and method of delivery), billing, and bank card information will be recorded. Your bank details are not stored by SPRING COURT but rather by its payment service provider, on secure servers. To prevent payment fraud, SPRING COURT reserves the right to verify the personal information You provide and take any measures deemed necessary to verify that the person whose bank account is to be debited is actually the person who placed the order.

Accordingly, proof of identity and/or residence and/or bank documents (bank account identification form (RIB) or a voided check) may be required. If You fail to respond to such a request within two days of SPRING COURT's request, the order in question will be canceled automatically and You will not be able to file any subsequent complaints.

SPRING COURT also reserves the right to automatically cancel orders that present one or more risk factors associated with fraudulent bank card use.

8. TRANSACTION SECURITY

SPRING COURT makes every effort to ensure the confidentiality and security of data sent via the Internet and the website www.springcourt.com. To this end, the website uses a Secure Socket Layer (SSL) secure payment system.

9. RIGHT OF WITHDRAWAL – EFFECTS

You have the right to withdraw from this contract, without providing reason, within thirty days.

The withdrawal period will end thirty days following the date on which You, or a third party You designate (other than the carrier), takes physical possession of the item purchased.

If the order contains several items that are delivered separately, the withdrawal period will end thirty days following the date on which You, or a third party You designate (other than the carrier), takes physical possession of the last item.

If the order pertains to items delivered regularly over a given period of time, the withdrawal period will end thirty days following the date on which You, or a third party You designate (other than the carrier), takes physical possession of the first item.

If your order contains several items and You wish to return more than one item, upon exercising your right of withdrawal You must indicate each of the items You wish to have exchanged or refunded.

For any return, please contact our customer service team who will provide details of the returns process.

You must register your return request with our Customer Service team or it will not be processed and SPRING COURT could not be responsible of return costs.

Item(s) must be returned in new and unused condition, in their original, fully intact box, with the return label provided to You by SPRING COURT.

You will be liable only for depreciation of the item resulting from handling other than that required to determine its nature and characteristics and ensure that it is in good working order.

10. EXCHANGES

Depending on delivery countries, You can request for the exchange of size on all items ordered on our Site, provided that the exchange item is of equal value as the returned product. Exchanges are subject to availability, depending on stock fluctuations. They will be sent to You free of charge upon receipt of the product to be exchanged, provided that the product is returned to SPRING COURT with its original packaging intact, and it has not been worn, washed, ironed, altered, or soiled. Sale items cannot be exchanged but they can be returned for a full refund.

11. REFUNDS

Refunds will be made few days of receiving your return, by the same means of payment you used for the initial transaction on our Site, in accordance with the return process with its original packaging and intact product.

Refunds may be withheld until Spring Court has received the item or until you provide proof that it has been shipped. The date taken into account will be that of the first event to occur.

13. LIABILITY

SPRING COURT is liable to You by operation of law for proper performance of the contract.

SPRING COURT will not, however, be liable for failure to perform or unsatisfactory performance of the contract entered into in the event of force majeure, occurrence of an event attributable to You, or any inconvenience or unforeseeable and uncontrollable damage that is attendant upon use of the Internet, including in particular service disruptions, outside intrusions, or the presence of computer viruses.

The Website contains hypertext links that may lead to other websites. SPRING COURT will not be liable for the content of such websites should they violate applicable laws and regulations.

14. WARRANTIES

Warranty of fitness

All items offered by SPRING COURT are subject to the warranty of fitness provided for under Articles L211-4 et seq. of the French Consumer Code (Code de la consommation).

To be fit for purpose, the product must be fit for the ordinary purposes for which similar goods are to be used and match the description provided on the Website or present the qualities that a buyer can reasonably expect of the product in view of the public statements made by the seller, the manufacturer, or its representative, particularly in advertising or on labels.

The images appearing on the Website and the rendering of their colors depend on the screen and computer systems used. Therefore, color deviations are not necessarily defects.

If a product purchased via the Website is defective, please report it to us using the form provided in the Customer Service section of our Website, and send us photographs showing the product's defect.

If the defect is proven, we will repair or replace the product as prescribed by Article L211-9 of the French Consumer Code.

If the product cannot be repaired or exchanged, You will be offered a full or partial refund, depending on the circumstances in question.

You will receive the refund within a maximum of 14 days.

SPRING COURT cannot be held liable, however, for any misuse and/or intensive use of items on your part.

Warranty againtst hidden defects

If the hidden defect is proven, You may return the product for a full refund, or keep the product and receive a partial refund. Actions in connection with hidden defects must be brought within two years after the defects are discovered.

15. PERSONAL DATA

SPRING COURT collects personal data for the purpose of creating customer accounts and processing orders.

Certain personal data is essential for creating and using customer accounts. These data fields are marked with an asterisk.

Customer accounts cannot be created and used unless this mandatory information is provided.

Other personal data requested is optional.

The personal data collected will be treated as confidential and will not be sent to third parties without your prior express consent.

In accordance with French Act No. 78-17 of January 6, 1978 on data processing, filing systems, and civil liberties and the European General Data Protection Regulation you have the following rights :

SPRING COURT reserves the right, however, to refuse requests that are clearly abusive, particularly in terms of their number or their repeated or systematic nature.

SPRING COURT agrees to use prescribed methods to prevent the integrity and confidentiality of the personal data we collect from being compromised.

However, due to the nature of the Internet, we cannot guarantee the security, confidentiality, and integrity of data transmitted by that means. In particular, SPRING COURT cannot be held liable for the loss, disclosure to a third party, or fraudulent use of your login information where it is not attributable to SPRING COURT.

18. GOVERNING LAW

These General Terms and Conditions of Sale and any contract entered into with You are governed solely by French law.

19. E-GIFT CARD

  • Subject

The present General Terms and Conditions of the Spring Court E-Gift Card apply to the sale of any Spring Court E-Gift Card distributed by the TH company. GRIMMEISEN (hereinafter "Spring Court"), a simplified joint-stock company (SAS) registered in the Paris Trade and Companies Register under 572 221 174, whose principal office is located at 5, passage Piver, 75011 Paris, France is the owner and operator of the Spring Court brand.

The Spring Court E-Gift Card is an electronic gift card, exclusively available on the www.springcourt.com site and intended for the purchase of products in all collections on said site.

Purchase of the Spring Court E-Gift Card implies unconditional acceptance of the present General Terms and Conditions of the Spring Court E-Gift Card.

  • Amounts and validity

The Spring Court E-Gift Card is available in various amounts according to the purchaser's choice.

It is valid for two (2) years from the date of email to the recipient.

The Spring Court E-Gift Card may be used any number of times until the total amound has been used.

  • Ordering

When buying the Spring Court E-Gift Card, the purchaser selects the amount and has the option to add a personalised message to the recipient.

The Spring Court E-Gift Card is sent by email to the address supplied by the purchaser.

The purchaser may also download and print the Spring Court E-Gift Card in PDF format.

  • Use

The Spring Court E-Gift Card is valid exclusively on the www.springcourt.com site for the purchase of products available online.

It is neither valid for use in stores nor for the purchase of other gift cards.

In the event of insufficient funds to cover a purchase, the recipient may use a supplementary method of payment.

The General Terms and Conditions of the website www.springcourt.com legally apply to any purchases made with the Spring Court E-Gift Card.

Any reselling of the Spring Court E-Gift Card is strictly prohibited.

  • Refund and Right of Withdrawal

In accordance with article L221-28 of the Consumer Code, the right of withdrawal does not apply to gift cards due to their personalised nature.

The Spring Court E-Gift Card is not subject to refunds or exchanges. In the event of an error attributable to Spring Court, a refund may be provided following a check by customer services.

  • Conditions of Non-Use and Loss

In the event of loss, theft or fraudulent use, no reissue of the Spring Court E-Gift Card shall be possible.

Any reselling of the Spring Court E-Gift Card is strictly prohibited.

  • Responsability

Spring Court shall not be held responsible in the event of temporary malfunction of the site preventing use of the Spring Court E-Gift Card.

Spring Court reserves the right to modify the present Terms and Conditions for the Spring Court E-Gift Card at any time. Such modifications shall not apply to Spring Court E-Gift Cards sold before the date of modification.

  • Personal data - Data Protection Act

Spring Court is the owner of all personal data transmitted during use of the website www.springcourt.com. This data will be used for managing the services related to the use of the Spring Court E-Gift Card. The buyer or recipient has the right to access, correct, and request the deletion of their personal data, as well as the right to object to its processing for legitimate reasons and to request its limitation or portability, where applicable.

  • Governing Law

These General Terms and Conditions of Sale for the Spring Court E-Gift Card are subject to French law. In the event of a dispute, the parties will endeavour to reach an amicable resolution before initiating any legal action.
